The Fourth Circuit’s published January 13, 2025 opinion in United States v. Charles Anthony Pittman, No. 22-4463, affirmed the district court’s judgment in the Fayetteville Market House case. The opinion records a 2020 guilty plea to a two-count information and a sixty-month sentence on Count 1 under 18 U.S.C. § 844(f)(1) and (2). The panel declined the statutory-coverage challenge because the guilty plea waived it, and rejected the untimely as-applied constitutional challenge under plain-error review; it did not decide that every constitutional challenge was waived by the plea.
