Biography
Vinh Tan Nguyen, a Vietnamese-American age 63, was convicted of misuse of a passport to facilitate an act of international terrorism for his role in a plot to bomb the Vietnam Embassy in the Philippines. He admitted storing explosives and testing bombs in Manila. Sentenced to 14 months federal prison plus 2 years supervised release.
The Ninth Circuit’s August 14, 2014 decision records FBI arrest in Saipan on December 12, 2006 and transfer to Guam on December 14 through law-enforcement parole. That parole was an immigration entry mechanism, not release from custody. On November 14, 2007, Nguyen pleaded guilty to passport misuse to facilitate international terrorism and received a fourteen-month term. The majority remanded for Convention Against Torture deferral because of the risk of torture in Vietnam; this did not vacate the passport conviction or establish physical discharge from US custody.
