Biography

Nikki Hubbard was one of eleven anti-fascist counter-protesters prosecuted after confrontations with supporters of Donald Trump at the January 9, 2021 Patriot March in Pacific Beach, San Diego. Prosecutors used a conspiracy-to-riot theory that defense attorneys and supporters described as an ideologically selective prosecution. Nikki Hubbard pleaded guilty to charges arising from the counter-protest and received Four years for the Pacific Beach case plus eight consecutive months for an unrelated case, for a total term of four years and eight months.

Sources

The original Pacific Beach indictment, SCD274477, was returned and filed on May 23, 2022, and signed for the prosecution by Deputy District Attorney Makenzie R. Harvey. Its twenty-nine counts were allocated across eleven defendants; they are not all charges against each individual. The September 2023 prosecution opposition supplies procedural history and argues for retaining the indictment, rather than constituting a verdict or a finding that its disputed factual allegations are true. This source does not establish a new arrest date, completed jail interval or release endpoint. The same prosecution history identifies the defendant under the former case name Erich Louis Yach and reports a guilty plea on September 28, 2022. The existing preferred name and known sentence remain unchanged.

The May 23, 2022 original indictment explicitly records the date of birth as 1984-01-07. This replaces the approximate date previously recorded here.
