Biography
Leo Ellis was an IWW member convicted under California criminal-syndicalism law. The existing account describes arrest in November 1919, escape in May 1920 and recapture in 1926; the precise custody boundaries still require original records. A June 1928 contemporary report places him in Folsom Prison. Scholarly research reports his release in September 1928.
The May 1927 Labor Defender reports Folsom release in February 1927, conflicting with the existing September 1928 endpoint and later custody reporting. 1920s custody review: Ahmed White, Oregon Law Review 85, page 758 and note 612, reports September 1928 release, citing Industrial Worker of September 29. The scholarly text gives September 29 as the day, but because that is also its newspaper date and the original discharge report has not been inspected, only the month is recorded. The Daily Worker June 21, 1928 page 4 explicitly places Ellis in Folsom, not San Quentin, and anticipates a September expiration; a predicted date is not used as actual release. The inherited November 1919 arrest is marked at month precision, consistent with the biography. Exact first admission and the escape/recapture custody boundaries remain unresolved. The Stockton list describes Ellis as on trial, distinct from the named convicted defendants and those free on their own recognizance. It supplies no new final judgment or physical-custody endpoint.
