Biography
Joseph W. Scherrer was arrested with the Denver Smith Act defendants on August 1, 1954 and released on $5,000 bail. A jury convicted the group on May 25, 1955, but an appellate court ordered a new trial after the Supreme Court’s Yates decision. A second conviction was also reversed in 1961 because prosecutors withheld hundreds of documents. Scherrer remained free on bail while the litigation continued; no service of a prison sentence has been established.
