Biography
John Earl Johnson, 26, was found with CDs containing terrorism information / explosive-making instructions and was connected to the Albany pizzeria case (Yassin Aref). Pleaded guilty; 46 months federal prison + supervised release.
In Johnson v. Guiffere, 2007 WL 3046703, the court described John Earl Johnson's federal pretrial detention at Montgomery County Jail in New York. He requested a diet consistent with his Islamic beliefs on June 13, 2003, following his transfer to the jail; the ruling states that he transferred out on July 29, 2003. Johnson challenged the refusal of a vegetarian-plus-fish diet. The court found factual disputes on the religious-exercise and equal-protection claims but dismissed the claim against Sergeant Guiffere on qualified-immunity grounds. July 29 was a transfer, not a release from custody.
