Biography
Jack Small was one of four May’s Department Store strikers arrested December 28, 1935 and tried on rioting charges in Kings County Court, Part 1, before Judge Brancato. The May 12 report says trial began the previous day, with one juror selected and adjournment until Wednesday. It also reports separate assault charges against Small and Morris; it gives no verdict, jail admission or precise release. No maximum possible punishment is counted as time served. The January 29, 1936 Daily Worker names Small with Elsie Monakian and Jack Winkler in a January 28 depot-package arrest involving an alleged valerian stench bomb. The defense described a forged letter. This is separately dated from the existing December 28, 1935 riot arrest. The May 22 paper, page 4, later reports a disorderly-conduct dismissal but $100 bail on an assault accusation; it does not establish how long he was actually jailed. Page 4 announces a May 11 trial with Joe Dazzo in Special Sessions Court of Kings County, Part One, for inciting to riot in the May’s strike. Sid Morris and Jack Small also faced assault counts. It describes ILD opposition to District Attorney William F. X. Geoghan’s attempted conspiracy prosecutions and replacement coercion cases. The announcement is a scheduled proceeding, not a verdict or discharge; the separately reported actual May 11 opening remains intact. The February 24, 1936 Daily Worker reports a separate February 22 May's strike arrest and February 23 arraignment before Mark Rudich for assault on a police officer. Small said police had beaten him so badly he could barely walk. He and Pat O'Shea, Joe Costa and I. Enray posted $200 bail each; trial was scheduled March 2. This is distinct from his December 28, 1935 and January 28, 1936 cases. Source: https://www.marxists.org/history/usa/pubs/dailyworker/1936/v13-n047-NY-feb-24-1936-DW-Q.pdf#page=4
