Biography
Eugene Levin was a physician drafted into the Army under the Doctors Draft Law and denied a commission after invoking the Fifth Amendment on a loyalty questionnaire. He challenged his continued service through a habeas corpus petition, and a federal court ordered the Army to commission him at an appropriate rank or discharge him. He received an honorable discharge in June 1954. The case involved compulsory military service rather than jail or prison confinement.
