Biography

Carlos Jimenez is a U.S. citizen arrested after an encounter with federal immigration agents in Ontario, California, on October 30, 2025. He told the court he approached them to warn that children would soon arrive at a nearby school bus stop. An agent shot him in the shoulder; he went to a hospital and was taken into federal custody after treatment. Prosecutors alleged that his reversing vehicle threatened an officer. Jimenez denied the allegation. He was released on October 31 on $10,000 bond with an ankle monitor. In May 2026, the parties disclosed a diversion agreement under which prosecutors could seek dismissal after October 31, 2026. He maintained his not-guilty plea; the agreement did not itself dismiss the case.

Jimenez’s April 2026 discovery motion sought personnel, use-of-force and investigative records concerning the October 30, 2025 Ontario encounter and shooting. The defense argued that officers used excessive force and that disclosure was required under Rule 16, Brady and Henthorn. This is a defense request, not an order granting discovery or dismissing the indictment. The document carries an April 9 filing stamp and April 10 counsel signatures. Later diversion and release information is separate from this motion. Source: https://www.nacdl.org/getattachment/cd8b0922-40f6-4542-9415-b24684757ddf/d-gov-uscourts-cacd-996172-53-0.pdf#page=9

Plea and procedural distinction

The May 6, 2026 joint stipulation, document 65, page 2 footnote expressly states that Jimenez maintained his not-guilty plea entered at arraignment. That plea has been added without assigning an unsupported plea day. The filing requests a discovery-production stay through November 8 and describes possible dismissal after diversion ending October 31, 2026. It is a request signed by counsel, not a completed dismissal, a conviction, or a physical release record. Existing custody dates remain unchanged.
