Reports on protest prosecutions often use “terrorism” to describe several different legal actions. A state criminal charge, a federal sentencing enhancement and a sanctions designation each have different requirements and consequences.
The Stop Cop City indictment charged 61 people under Georgia’s racketeering law. Five also faced domestic-terrorism and arson charges. Those were state charges, not a federal sentencing enhancement.
Jessica Reznicek’s case involved a federal enhancement applied at sentencing after a pipeline-damage conviction. The appeals court upheld her eight-year sentence without deciding whether the enhancement itself was proper.
