John Cyril Hellman was a Montana Communist and former state Progressive Party director arrested by FBI agents in Butte on April 5, 1956 under the Smith Act’s membership clause. His bail was reduced from $20,000 to $5,000, and he was released on a property bond. He was later convicted, but the Ninth Circuit reversed on December 29, 1961 and directed dismissal because the evidence did not establish the required specific intent.
