Biography

Herman Lemke was from eastern Pennsylvania. Herman Lemke served in Atlanta Penitentiary from December 30, 1918, to June 10, 1920.

The presidential-clemency table in the 1921 Senate amnesty hearings records a sentence imposed December 18, 1918: Two years for false statements to obstruct recruiting. Pardon granted June 10, 1920; the recommendation discusses a dissent by Justice Brandeis and the trial judge's conclusion that actual imprisonment was not required. A pardon, commutation, nominal expiration or parole eligibility is not itself evidence of the day of physical release; the imposed or reduced term is not a measured time served.
