Biography

Ahmed Khalfan Ghailani was held in US custody in connection with CIA/Guantanamo/mainland criminal custody. Individually documented detention or imprisonment establishes custody beyond 24 hours. CIA, Guantanamo and mainland federal custody were successive US stages. Transfer to the mainland did not itself end US custody.

CCR’s 2010 report distinguishes capture in 2004, secret CIA detention, transfer to Guantanamo in September 2006 and transfer to New York for trial in June 2009. It reports that the court denied a speedy-trial dismissal motion in July 2010. The transfers did not end physical custody and do not create additional imprisonment episodes. After approximately two years of CIA confinement he entered US military custody at Guantanamo in2006, under historical ISN10012, and moved to US civilian custody inJune2009. These were later US custody stages, not releases. His current stored prisoner register is BOP02476-748 and must be preserved. The review list dated January 22, 2010 identifies Ahmed Ghailani, Guantanamo ISN 10012, as referred for prosecution. That administrative referral is distinct from a conviction or release, and the historical Guantanamo identifier is separate from his federal prison register number.
